Terms of Service

The terms that govern your access to and use of the WASHWise mobile application, web portal and related services.

WASHWise is operated by the Liaison Office of MIS Foundation Terre des hommes (UIN: KOL008000056), Kolkata, India (“Tdh”, “we”, “us”). By downloading, installing, signing in to or using WASHWise, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the platform.

Purpose

Digital tool for WASH FIT, Kayakalp, stock management and infection control in healthcare facilities.

Intended users

Authorised health staff and Tdh programme personnel only.

Not medical advice

An administrative and quality monitoring tool. It does not provide clinical diagnosis or medical advice.

Non-commercial

No advertisements and no marketing trackers.

Data responsibility

Tdh manages platform data as Data Fiduciary, as described in the Privacy Policy.

Governing law

The laws of India, with jurisdiction of the competent courts in India.

About the platform and intended use

WASHWise is a digital health initiative created by Terre des hommes (Tdh) for public health facilities in West Bengal, India. It provides tools to:

  • conduct structured assessments based on the WASH FIT (Water and Sanitation for Health Facility Improvement Tool) and Kayakalp frameworks;
  • maintain digital stock registers for infection prevention supplies such as disinfectants, PPE and bleaching powder;
  • access training resources, standard operating procedures and infection control quizzes;
  • report, track and resolve facility upkeep and maintenance issues; and
  • view aggregated performance dashboards and analytics through WASH Darpan.

User eligibility and account security

Professional access

WASHWise is for authorised healthcare personnel, including Infection Control Nurses, Block Medical Officers of Health, Chief Medical Officers of Health, state-level health officers, and authorised Tdh programme, administrator and support staff.

Your responsibilities

  • Accounts are created by authorised Tdh administrators.
  • Keep your professional information accurate and up to date.
  • Keep your login credentials safe and never share them.
  • If you suspect unauthorised use of your account, tell your administrator or use the Support section in the app immediately.

Acceptable use

You agree to use WASHWise only for authorised, professional public health and facility management work.

You agree to

  • Submit truthful, accurate and verifiable assessment responses.
  • Keep reliable records of stock counts, receipts and consumption.
  • Upload photos only to document facility conditions, hygiene practices or maintenance needs.
  • Explain to cleaning staff what is recorded about them and why, and record their consent in the app before entering their details.

You agree not to

  • Falsify records: submit misleading or manipulated scores, stock figures or photos.
  • Upload patient data: record or photograph patient histories, clinical records or identifiable patient faces.
  • Compromise security: bypass access controls, access other accounts, or introduce malicious code or scraping scripts.
  • Reverse engineer: decompile, disassemble or try to extract the source code of the app or website.
  • Commercialise: sell, rent or redistribute the platform without written approval from Tdh.

Administrative and non-medical disclaimer

WASHWise is an administrative, quality assurance and supply management tool.

It does not provide clinical diagnoses, treatment plans or emergency medical services. Scores, alerts and learning materials are reference guides for trained health workers and do not replace professional judgement, statutory guidelines or clinical protocols.

Intellectual property

Platform ownership

All rights in the WASHWise platform, including the mobile app, web portal, software, scoring engines, logos and visual design, belong to Terre des hommes (Tdh) and its development partners.

Public health frameworks

Frameworks such as the WHO/UNICEF WASH FIT guidelines and the Kayakalp criteria of the Ministry of Health and Family Welfare remain the property of their originating bodies. WASHWise provides a digital implementation of these standards.

Facility and operational data

Facility metrics, assessment responses and stock figures submitted by authorised users are managed by Tdh to host, analyse, aggregate and maintain the platform, in line with the Privacy Policy. At the end of the programme they may be handed over to the competent public health authority.

Offline features and data synchronisation

  • You can complete assessments and update stock registers offline. Entries are saved on your device.
  • You are responsible for connecting to the internet periodically so local records can synchronise with the central server.
Tdh is not responsible for data lost through device resets or reinstalling the app before offline records have been synchronised.

Third-party infrastructure

  • Microsoft Azure: cloud hosting with encrypted database and file storage in the Central India region.
  • Google Firebase: push notifications (Cloud Messaging) and crash reporting (Crashlytics).
  • Google Play: app distribution and in-app updates.

How these providers handle personal data is described in our Privacy Policy. Tdh is not liable for temporary interruptions caused by third-party outages.

Disclaimer of warranties

WASHWise is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. To the fullest extent permitted by law, Tdh disclaims all warranties, including merchantability, fitness for a particular purpose and non-infringement, and does not guarantee uninterrupted or error-free operation.

Limitation of liability

To the maximum extent permitted by applicable law:

  • No indirect damages. Tdh, its representatives, staff and partner organisations are not liable for indirect, incidental, special or consequential damages, including loss of data or downtime, arising from use of or inability to use the platform.
  • Liability cap. Tdh’s total liability under these Terms will not exceed ₹5,000 (Five Thousand Indian Rupees).

Account suspension and termination

We may suspend or end your access if:

  • you breach these Terms or applicable law;
  • your assignment at the health facility ends;
  • your supervising officer (such as a BMOH or CMOH) requests it; or
  • it is necessary to protect platform security, data integrity or public safety.

Provisions on intellectual property, disclaimers, limitation of liability and governing law survive termination.

Governing law and jurisdiction

These Terms are governed by the laws of India. Any legal proceedings related to them are subject to the jurisdiction of the competent courts in India.

Updates to these terms

We may update these Terms as the platform develops. Revised versions will be published on this page with a new “Last updated” date. Continuing to use the platform after changes are published means you accept the revised Terms.
